Hunde-/ Katzensalon Pet Wash Imhof GmbH. BaselVertragsabschluss
- Der Vertrag zwischen Pet Wash Basel und den Auftraggebern kommt mündlich zustande.Dienstleistungen und Konditionen
- Alle Pflegebehandlungen und Dienstleistungen für Hunde im Hundesalon Pet Wash Basel und an allen anderen Orten, an welchen der Hundesalon dieselben Leistungen erbringt, erfolgen nach Massgabe dieser Allgemeinen Geschäftsbedingungen und den fachlichen Qualitätsan-forderungen eines Hundesalons.
- Generell und grundsätzlich behält sich Pet Wash Basel vor, Aufträge anzunehmen oder abzu-lehnen. Der Leistungsumfang wird von Arbeitsbeginn mündlich mit dem Kunden vereinbart. Die Vertragsdauer ist auf den Zeitraum der zur Pflege benötigten Zeit befristet.
- Pet Wash Basel arbeitet ausschliesslich nach Terminvereinbarung. Sollte der Kunde einen Termin nicht wahrnehmen können, verpflichtet er sich, diesen mindestens 24 Stunden vorher abzusagen. Wird ein Termin nicht rechtzeitig abgesagt, wird eine Ausfallentschädigung in der Höhe von CHF 50.00 in Rechnung gestellt.
- Im Zentrum aller Behandlungen steht die Gesunderhaltung des Tieres, dessen Wohlbefinden und die Beachtung der geltenden Tierschutzbestimmungen. Wünsche, die diesen Anforderun-gen nicht gerecht sind, werden nicht ausgeführt. Die Ausführung der Behandlung liegt im pflichtgemässen Ermessen des Hundesalons.
- Während der Behandlung wird der Hund an einem Bauch- oder Halsband angeleint. Diese Massnahme dient dem Schutz des Tieres und soll möglichen Verletzungsgefahren (wie z.B. Hinunterfallen vom Tisch) vorbeugen.
- Bei sehr alten, nervösen oder ängstlichen Hunden wird die Behandlung nur so lange ausge-führt, wie es der Hund erträgt und zulässt. Im Interesse des Hundes wird die Behandlung un-ter Umständen frühzeitig abgebrochen.
- Im Hinblick auf die Gesundheit und das Wohlbefinden des Hundes behält es sich Pet Wash Basel vor, die hierfür nötigen Mehraufwendungen zur Behandlung des Hundes ohne Abspra-che mit dem Tierhalter zu leisten (z.B. bei Flohbefall, zusätzlichem Zeitaufwand bei starker Verfilzung oder bei Zeitverzögerungen durch Unruhe des Hundes).Preise/Bezahlung
- Die Preise werden mit dem Kunden mündlich vereinbart.
- Verhindert der Hund aufgrund seines Verhaltens die Weiterführung einer Behandlung und muss diese deshalb frühzeitig abgebrochen werden, ist der Mindestpreis gemäss Preisliste zu bezahlen.Mehraufwendungen, deren Erfordernis sich im Hinblick auf die Gesundheit und das Wohlbefinden des Hundes während der Behandlung ergeben haben, werden dem verein-barten Preis hinzugerechnet.
- Die Bezahlung des vereinbarten Behandlungspreises (sowie allfälligen Mehraufwendungen) ist bei Abholung des Tieres bar bzw. via EC oder TWINT fällig. Es gibt keine Pflege auf Rech-nung.
- Bei nicht fristgerechter Bezahlung des Behandlungspreises gelten sinngemäss die Bestim-mungen zum Schuldnerverzug gemäss Schweizerischem Obligationenrecht.Haftung
- Der Tierhalter/ die Tierhalterin versichert, dass es mit dem zu behandelten Tier bisher zu keinerlei Vorfällen gekommen ist, die einer Ordnungsbehörde zur Anzeige gebracht werden mussten.
- Für alle Hunde sollte eine gültige Haftpflichtversicherung durch den Tierhalter abgeschlossen sein.
- Für Schäden oder Krankheiten, die das Tier während der Abwesenheit seines Tierhalters/ seiner Tierhalterin bzw. während der Behandlungszeit erleidet, kann der Hundesalon Pet Wash Basel nicht haftbar gemacht werden. Die Haftung vom Hundesalon ist ausdrücklich auf Vorsatz und grobe Fahrlässigkeit beschränkt.
- Bei sehr unruhigen oder verhaltensauffälligen Hunden oder Hunden mit stark verfilztem Fell kann sich u.U. die Gefahr der Selbstverletzung des Hundes erhöhen. In diesen Fällen über-nimmt der Hundesalon Pet Wash Basel keine Haftung. Auch für alte Hunde (ab ca. 8-10 Jah-re) kann eine erfolgreiche Behandlung nicht garantiert bzw. keine Verantwortung übernommen werden.
- Der Hundesalon Pet Wash Basel haftet nicht, wenn der Hund durch höhere Gewalt verletzt wird, wenn trotz aller nach den Umständen gebotenen Sorgfalt das Tier entflieht und hieraus dem Kunden oder einem Dritten ein Schaden entsteht, wenn trotz ausgewiesener Verträglich-keit der Hund durch Pflegeprodukte geschädigt wird oder wenn der Hund durch zu starke Verfilzung oder zu starke Unruhe bei der Arbeit des Hundesalons trotz Einhaltung aller erfor-derlichen Vorsichtsmassnahmen verletzt wird.
- Der Tierhalter/ die Tierhalterin haftet ebenso für Schäden an Sachen oder anderen Tieren, die der Hund während seines Aufenthaltes im Hundesalon Pet Wash Basel oder an anderen Orten, an denen der Hundesalon Dienstleistungen erbringt, verursacht.
- Im Falle der Verletzung des Personals des Hundesalons durch den Hund tritt der Tierhalter für anfallende Genesungskosten und allfälligen Verdienstausfall mit seiner Hundehalterhaft-pflichtversicherung oder privat ein.
- Der Hund ist unmittelbar nach der Behandlung auf etwaige Mängel zu untersuchen, die dann auch nach Möglichkeit unverzüglich korrigiert werden. Schäden oder Mängel sind umgehend nach Kenntnisnahme dem Hundesalon zu melden. Spätere Beanstandungen können nicht be-rücksichtigt werden.
- Liegt ein vom Kunden zu vertretender Mangel vor, der nicht umgehend korrigiert werden kann, ist Pet Wash Basel zu mindestens zwei Nachbesserungen berechtigt, bevor Ersatzvor-nahmen oder Zusatzkosten etc. vom Hundebesitzer geltend gemacht werden können.
- Bei starken Verfilzungen können durch das Entfernen Hautirritationen und Rötungen entste-hen. Hierfür kann Pet Wash Basel nicht haftbar gemacht werden. Die Verantwortung obliegt in diesem Fall ausschliesslich dem Tierhalter/ der Tierhalterin.
-Mit jeden Auftrag akzeptiert der Kunde automatisch die Allgemeinen Geschäftsbedingungen.Persönliche Daten
- Der Kunde erklärt sich damit einverstanden, dass personen-, tier- und sachbezogene Daten in die Kundendatei von Pet Wash Basel aufgenommen werden. Diese Daten werden nicht an Dritte weitergegeben ausser in Notfällen, beispielsweise an einen Tierarzt oder den Tier-schutz.
- Pet Wash Basel verwendet ggf. Fotos und Videos von Hunden und Katzen auf der eigenen Home-page www.petwashbasel.ch, auf Instagram oder auf Marketingmaterial (z.B. Flyer).Gerichtsstand

- El contrato entre Pet Wash Basel y el cliente se celebra verbalmente.Servicios y condiciones
- Todos los tratamientos y servicios de peluquería canina en la peluquería canina Pet Wash Basel y en todos los demás lugares en los que la peluquería canina preste los mismos servicios se realizarán de conformidad con las presentes Condiciones Generales y con los requisitos de calidad profesional de una peluquería canina.
- En general y por principio, Pet Wash Basel se reserva el derecho de aceptar o rechazar pedidos. El alcance de los servicios se acordará verbalmente con el cliente desde el inicio del trabajo. La duración del contrato se limita al tiempo necesario para el acicalamiento.
- Pet Wash Basel trabaja exclusivamente con cita previa. Si el cliente no puede acudir a una cita, se compromete a cancelarla con al menos 24 horas de antelación. Si una cita no se cancela a tiempo, se cobrará una tasa de cancelación de 50,00 CHF.
- El objetivo de todos los tratamientos es el mantenimiento de la salud del animal, su bienestar y el cumplimiento de la normativa aplicable en materia de protección animal. Las solicitudes que no cumplan estos requisitos no se llevarán a cabo. El tratamiento se realiza a discreción de la residencia canina.
- Durante el tratamiento, el perro estará sujeto con una correa o collar. Esta medida sirve para proteger al animal y evitar posibles riesgos de lesiones (por ejemplo, que se caiga de la mesa).
- En el caso de perros muy viejos, nerviosos o miedosos, el tratamiento sólo se lleva a cabo durante el tiempo que el perro pueda tolerarlo. En interés del perro, el tratamiento puede interrumpirse en una fase temprana.
- En interés de la salud y el bienestar del perro, Pet Wash Basel se reserva el derecho de incurrir en gastos adicionales para el tratamiento del perro sin consultar con el propietario de la mascota (por ejemplo, en el caso de infestación por pulgas, el tiempo adicional necesario en el caso de estera severa o retrasos de tiempo debido a la inquietud del perro).Precios/pago
- Los precios se acuerdan verbalmente con el cliente.
- Si el comportamiento del perro impide la continuación del tratamiento y éste debe finalizarse antes de tiempo, deberá abonarse el precio mínimo según la lista de precios. Los gastos adicionales que resulten necesarios en relación con la salud y el bienestar del perro durante el tratamiento se añadirán al precio acordado.
- El pago del precio acordado para el tratamiento (así como cualquier gasto adicional) deberá efectuarse en el momento de la recogida del animal en metálico o mediante EC o TWINT. No se puede hacer pago por plazos ni facturas.
- En caso de demora en el pago del precio del tratamiento, se aplicarán mutatis mutandis las disposiciones sobre demora del deudor según el Código de Obligaciones suizo.
Responsabilidad
- El propietario del animal asegura que hasta la fecha no se han producido incidentes con el animal a tratar que hayan tenido que ser notificados a una autoridad reguladora.
- El propietario del animal debe disponer de un seguro de responsabilidad civil válido para todos los perros.
- La peluquería canina Pet Wash Basel no se hace responsable de los daños o enfermedades sufridos por el animal durante la ausencia de su propietario o durante el periodo de tratamiento. La responsabilidad de la peluquería canina se limita expresamente a dolo y negligencia grave.
- En el caso de perros muy inquietos o con problemas de comportamiento o con el pelo muy enmarañado, el riesgo de que el perro se haga daño puede aumentar en determinadas circunstancias. En estos casos, la peluquería canina Pet Wash Basel no asume ninguna responsabilidad. Tampoco en el caso de perros de edad avanzada (aprox. 8-10 años) se puede garantizar el éxito del tratamiento y no se puede asumir ninguna responsabilidad.
- La peluquería canina Pet Wash Basel no se hace responsable si el perro sufre daños por fuerza mayor, si el animal se escapa a pesar de todos los cuidados exigidos por las circunstancias y esto causa daños al cliente o a un tercero, si el perro sufre daños por los productos de peluquería a pesar de la compatibilidad demostrada o si el perro sufre daños por una estera excesiva o una inquietud excesiva durante el trabajo de la peluquería canina a pesar del cumplimiento de todas las medidas de precaución necesarias.
- El propietario del animal también es responsable de los daños a la propiedad o a otros animales causados por el perro durante su estancia en la peluquería canina Pet Wash Basel o en otros lugares donde la peluquería canina preste sus servicios.
- En caso de lesiones al personal de la peluquería canina causadas por el perro, el propietario del animal deberá abonar los gastos de recuperación que se produzcan y el lucro cesante con su seguro de responsabilidad civil para propietarios de perros o de forma privada.
- El perro debe ser examinado inmediatamente después del tratamiento para detectar cualquier defecto, que también se corregirá inmediatamente si es posible. Los daños o defectos deben comunicarse a la peluquería canina inmediatamente después de tener conocimiento de ellos. No se admitirán reclamaciones posteriores.
- Si existe un defecto del que es responsable el cliente y que no puede corregirse inmediatamente, Pet Wash Basel tiene derecho a realizar al menos dos correcciones posteriores antes de que el propietario del perro pueda reclamar su sustitución o costes adicionales, etc.
- En el caso de esteras pesadas, irritación de la piel y enrojecimiento puede ocurrir como resultado de la eliminación. Pet Wash Basel no se hace responsable de ello. En este caso, la responsabilidad recae exclusivamente en el propietario de la mascota.
- Para cada pedido, el cliente acepta automáticamente las Condiciones Generales.
Datos personales
- El cliente acepta que los datos personales, relativos a los animales y a la propiedad se introduzcan en el fichero de clientes de Pet Wash Basel. Estos datos no se transmitirán a terceros salvo en casos de emergencia, por ejemplo a un veterinario o al servicio de protección de animales.
- Pet Wash Basel podrá utilizar fotos y vídeos de perros y gatos en su propia página web www.petwashbasel.ch, en Instagram o en material de marketing (por ejemplo, folletos).Jurisdicción

- The contract between Pet Wash Basel and the clients is concluded verbally.Services and conditions
- All grooming treatments and services for dogs at the Pet Wash Basel dog salon and at all other locations where the dog salon provides the same services shall be provided in accordance with these General Terms and Conditions and the professional quality requirements of a dog salon.
- In general and as a matter of principle, Pet Wash Basel reserves the right to accept or decline orders. The scope of services will be agreed upon verbally with the customer from the beginning of the work. The duration of the contract is limited to the time needed for the care.
- Pet Wash Basel works exclusively by appointment. If the customer is unable to keep an appointment, he undertakes to cancel it at least 24 hours in advance. If an appointment is not cancelled in time, a cancellation fee of CHF 50.00 will be charged.
- The focus of all treatments is the maintenance of the health of the animal, its well-being and the observance of the valid animal protection regulations. Requests that do not meet these requirements will not be carried out. The execution of the treatment lies in the obligatory discretion of the dog salon.
- During the treatment, the dog will be leashed by a belly band or collar. This measure is for the protection of the animal and to prevent possible risks of injury (such as falling off the table).
- In the case of very old, nervous or fearful dogs, the treatment is only carried out for as long as the dog can tolerate it. In the interest of the dog, the treatment may be stopped at an early stage.
- In the interest of the dog's health and well-being, Pet Wash Basel reserves the right to incur any additional expenses necessary to treat the dog without consulting the pet owner (e.g., in the case of flea infestation, additional time required in the case of severe matting, or time delays due to the dog's restlessness).Prices/Payment
- The prices are agreed upon verbally with the customer.
- If the dog's behavior prevents the continuation of the treatment and it has to be stopped early, the minimum price according to the price list has to be paid. Additional expenses, which are necessary for the health and well-being of the dog during the treatment, will be added to the agreed price.
- Payment of the agreed treatment price (as well as any additional expenses) is due upon collection of the animal in cash or via EC or TWINT. Payment by invoice is not possible.
- In the event of late payment of the treatment price, the provisions on debtor's default according to the Swiss Code of Obligations shall apply mutatis mutandis.Liability
- The animal owner assures that there have been no incidents with the animal to be treated that had to be reported to a regulatory authority.
- For all dogs, a valid liability insurance should be taken out by the animal owner.
- The Pet Wash Basel dog salon cannot be held liable for any damage or illness suffered by the animal during the absence of its owner or during the treatment period. The liability of the dog salon is expressly limited to intent and gross negligence.
- In the case of very restless dogs or dogs with behavioral problems or dogs with heavily matted fur, the risk of self-injury of the dog may increase under certain circumstances. In these cases, the dog salon Pet Wash Basel assumes no liability. Also for old dogs (from approx. 8-10 years) a successful treatment cannot be guaranteed and/or no responsibility be taken over.
- The dog salon Pet Wash Basel is not liable if the dog is injured by force majeure, if the animal escapes despite all the care required by the circumstances and this causes damage to the customer or a third party, if the dog is damaged by grooming products despite proven compatibility or if the dog is injured by excessive matting or excessive restlessness during the work of the dog salon despite compliance with all necessary precautions.
- The pet owner is also liable for damage to property or other animals caused by the dog during its stay at the Pet Wash Basel dog salon or at other places where the dog salon provides services.
- In the event of injury to the staff of the dog salon by the dog, the pet owner will pay for any recovery costs incurred and any loss of earnings with client`s dog owner liability insurance or 3rd party liability insurance.
- The dog is to be examined immediately after the treatment for any defects, which will then also be corrected immediately if possible. Damage or defects are to be reported to the dog salon immediately after becoming aware of them. Later complaints can not be considered.
- If there is a defect for which the customer is responsible and which cannot be corrected immediately, Pet Wash Basel is entitled to at least two rectifications before replacement or additional costs etc. can be claimed by the dog owner.
- In the case of heavy matting, skin irritation and redness may result from the removal. Pet Wash Basel cannot be held liable for this. In this case, the responsibility lies exclusively with the pet owner.
-With every order the customer automatically accepts the general terms and conditions.Personal data
- The customer agrees that personal, animal and property related data will be included in the customer file of Pet Wash Basel. This data will not be disclosed to third parties except in cases of emergency, for example to a veterinarian or animal protection.
